Terms of Use
Last updated: 20 September 2026
1. Introduction
These Terms of Use ("Terms") govern your use of Fayr, including the Fayr mobile application, the website at fayr.app, and related services.
Fayr is operated by Anderson Consultants Ltd ("Fayr", "we", "our", or "us").
By creating a Fayr account or using Fayr, you agree to these Terms.
If you do not agree to these Terms, you must not use Fayr.
Our Privacy Policy, available at fayr.app/privacy, explains how we collect and use personal information and should be read alongside these Terms.
2. Who We Are
•
Company: Anderson Consultants Ltd
•
Product: Fayr
•
Website: fayr.app
Anderson Consultants Ltd provides and operates the Fayr software and related services.
3. Eligibility
You must be legally capable of agreeing to these Terms in the country where you live.
If you are under 18, you should use Fayr only with the permission of a parent or guardian.
If you use Fayr as a driver, you must independently satisfy all legal requirements applicable to driving and carrying passengers, including any requirements relating to:
•
Minimum driving age
•
Driving licences
•
Vehicle ownership or permission to use the vehicle
•
Insurance
•
Vehicle taxation
•
Roadworthiness
•
MOT or equivalent testing
•
Car sharing, passenger contributions, and transport licensing
Purchases must be made using an Apple App Store or Google Play account that you are authorised to use.
4. What Fayr Does
Fayr is software designed to help people organise and keep track of shared car journeys.
Fayr may allow users to:
•
Create a shared journey or car pool
•
Invite other people to join a journey
•
Join a journey using a QR code or access code
•
Track journey distance and duration
•
Keep a record of drivers, passengers, and guests
•
Estimate the cost of a journey
•
Calculate suggested cost shares between participants
•
Record whether participants have paid or received an amount
•
Maintain journey and activity history
•
Configure vehicles and journey-cost settings
•
Access additional features through a paid Fayr plan
Features may vary depending on your device, operating system, Fayr plan, location, and application version.
5. Fayr Is Not a Transport Provider
Fayr does not provide transportation.
Fayr does not:
•
Employ or supply drivers
•
Own or supply vehicles
•
Operate a taxi, private-hire, minicab, chauffeur, or passenger transport service
•
Dispatch drivers
•
Guarantee that a journey will take place
•
Verify that a particular driver, passenger, or guest is suitable to travel with
•
Conduct background or safeguarding checks on users unless we expressly state otherwise
•
Verify driving licences, insurance, MOT status, vehicle condition, or other legal requirements
•
Supervise or control the way a vehicle is driven
•
Guarantee the conduct of another user
•
Collect passenger-to-driver journey payments on behalf of users
Drivers and passengers make their own arrangements about whether, when, and with whom they travel.
Any relationship concerning the provision of the actual journey is between the people participating in that journey, not between those participants and Fayr.
6. Your Account
You are responsible for providing accurate information when creating and maintaining your Fayr account.
You must:
•
Keep your login credentials secure
•
Not knowingly allow another person to impersonate you using your account
•
Notify us if you believe your account has been compromised
•
Keep information reasonably necessary for using Fayr accurate and up to date
You are responsible for activity carried out through your account unless the activity results from something for which we are legally responsible.
You may sign in using supported authentication providers such as Apple or Google. Use of those providers is also subject to their own terms.
7. Shared Journeys
When you create or participate in a shared journey, you are responsible for deciding whether the arrangement is suitable for you.
Fayr provides tools for recording and coordinating the journey but does not guarantee:
•
That a driver or passenger will attend
•
That someone will arrive at an agreed time
•
That the journey will follow a particular route
•
That the journey will be completed
•
That another participant will behave appropriately
•
That another participant will pay an amount they have agreed to pay
•
That information supplied by another participant is accurate
Users should exercise their own judgement when arranging shared journeys.
If you are travelling with someone you do not know well, you should take appropriate precautions for your personal safety.
In an emergency, contact the relevant emergency services. Fayr is not an emergency or roadside-assistance service.
8. Driver Responsibilities
If you use Fayr as a driver, you remain entirely responsible for the operation of your vehicle and compliance with applicable road and transport laws.
You must ensure, where applicable, that:
•
You hold an appropriate and valid driving licence
•
You are legally permitted to drive the vehicle
•
The vehicle is roadworthy
•
The vehicle has any required tax, registration, MOT, inspection, or equivalent certification
•
You have insurance appropriate for your use of the vehicle
•
Your insurance permits the type of car-sharing arrangement you undertake
•
The number of passengers carried does not exceed the legal or safe capacity of the vehicle
•
Passenger contributions comply with applicable laws, insurance conditions, and licensing requirements
•
You are fit and legally permitted to drive
•
You comply with road traffic laws
Fayr's passenger limits are product limits, not an assessment of the legal or safe passenger capacity of your vehicle.
For example, a Fayr plan allowing up to a particular number of passengers does not mean that your vehicle may legally or safely carry that number.
You must always follow the lower applicable limit.
9. Passenger and Guest Responsibilities
Passengers are responsible for deciding whether they wish to participate in a particular journey and travel with a particular driver.
Passengers must behave lawfully and reasonably and must not intentionally distract or interfere with the driver.
Where you add a guest to Fayr, you are responsible for ensuring that the information you enter about that guest is appropriate and reasonably necessary for managing the shared journey.
You must not use Fayr to create false or misleading records about another person.
10. Safe Use While Driving
You must not use Fayr in a way that makes driving unsafe or causes you to breach laws relating to mobile-device use while driving.
Drivers should configure or interact with Fayr before beginning a journey or while safely stationary where required.
Where functionality operates automatically during an active journey, you should not interact with the device unless it is safe and lawful to do so.
Road safety takes priority over the use of Fayr.
11. Location and Journey Tracking
Some driver features require access to device location information.
During an active journey, Fayr may use location information to:
•
Track journey progress
•
Measure distance
•
Calculate journey information
•
Calculate estimated cost shares
•
Produce journey records and summaries
Location and distance measurements can be affected by factors such as:
•
GPS accuracy
•
Device hardware
•
Signal availability
•
Operating-system behaviour
•
Battery-saving features
•
Network conditions
Fayr therefore does not guarantee that recorded distance, duration, route, or location information will always be exact.
You remain responsible for checking whether information produced by Fayr is appropriate for your intended use.
Further information about location data is available in our Privacy Policy.
12. Journey Costs and Cost Sharing
Fayr may estimate the cost of a shared journey and calculate suggested amounts attributable to individual participants.
Calculations may use information such as:
•
Distance travelled
•
Vehicle type
•
Fuel type
•
A Fayr estimate
•
A default journey-cost setting
•
A custom cost entered by the user
•
The number and participation of occupants
•
Currency and unit settings
These calculations are estimates.
Actual vehicle costs may differ because of factors including fuel prices, energy prices, vehicle efficiency, maintenance, depreciation, route conditions, driving style, insurance, taxation, and other expenses.
Fayr does not guarantee that an estimate represents:
•
The exact cost incurred by the driver
•
The correct amount legally chargeable to a passenger
•
A tax-deductible or tax-approved amount
•
An amount accepted by an insurer
•
A regulated taxi or private-hire fare
Any use within Fayr of terms such as "fare", "cost", "share", "contribution", or similar wording refers to a calculated amount within the app and does not mean that Fayr is providing or selling transportation.
13. Car-Sharing Contributions
Fayr is intended to support genuine shared journeys and cost sharing rather than commercial passenger transport.
Drivers are responsible for ensuring that amounts they request or accept from passengers comply with applicable:
•
Car-sharing laws
•
Taxi or private-hire licensing rules
•
Insurance conditions
•
Tax rules
•
Other legal or regulatory requirements
You must not rely on Fayr's calculated cost as confirmation that a particular payment is legally permissible.
In particular, where the law distinguishes between sharing running costs and making a profit from carrying passengers, the driver is responsible for remaining within any applicable rules.
Fayr does not provide legal, tax, insurance, or transport-licensing advice.
If you are uncertain about whether receiving passenger contributions affects your insurance or legal status, you should contact your insurer or obtain appropriate professional advice.
14. Payments Between Drivers and Passengers
Passenger-to-driver payments generally take place outside Fayr.
Fayr does not:
•
Hold those funds
•
Transfer those funds
•
Guarantee payment
•
Collect debts on behalf of users
•
Determine whether a payment dispute should be resolved in favour of one participant or another
Features allowing a passenger to mark an amount as paid, or a driver to confirm an amount as received, are record-keeping tools.
A status shown in Fayr is not independent proof that money was transferred.
Drivers and passengers remain responsible for resolving payment arrangements and disputes directly between themselves.
15. Environmental and Other Estimates
Fayr may display estimated environmental information, such as potential carbon dioxide or vehicle-use savings associated with sharing a journey.
Any such figures are estimates based on assumptions and available data.
They should not be treated as independently verified measurements of emissions avoided or environmental impact.
Similarly, currency conversions or comparable calculated information displayed by Fayr may be indicative rather than exact.
16. Fayr Plans
Fayr may offer free and paid plans.
The features and limits associated with each plan are displayed within Fayr or on the relevant store listing.
A free Fayr plan does not require a paid subscription.
Paid plans may provide additional functionality or higher usage limits.
Your active plan may affect features such as the maximum number of passengers that can be added to a journey.
Where a journey records plan limits when it begins, changing your plan during that journey may not alter the limits applying to that existing journey.
New limits may instead apply to subsequent journeys.
17. Fayr Plus Subscriptions
Fayr Plus is an auto-renewing paid subscription unless the purchase screen states otherwise.
The price, currency, billing period, taxes, and other purchase information will be shown to you before you confirm the purchase through the Apple App Store or Google Play.
The amount charged may differ between countries, currencies, platforms, or stores.
Subscriptions are processed by the store through which you purchase them.
Apple and Google Play auto-renewing subscriptions continue until cancelled, subject to the applicable store terms.
By purchasing Fayr Plus, you also agree to the applicable store's purchase and subscription terms.
18. Renewal and Cancellation
Unless stated otherwise when you purchase it, Fayr Plus renews automatically at the end of each billing period until cancelled.
You can manage or cancel your subscription through the store account through which you purchased it.
Cancelling normally prevents the next renewal. Access will ordinarily continue until the end of the period already paid for, subject to the applicable store rules and any refund or revocation.
Deleting Fayr or uninstalling the app does not itself cancel an App Store or Google Play subscription.
Deleting your Fayr account also does not necessarily cancel a store subscription.
If you want to stop future subscription charges, you should separately cancel the subscription through Apple or Google.
19. Refunds and Consumer Rights
Refunds for purchases made through Apple or Google are subject to:
•
The rules and processes of the relevant store
•
These Terms where applicable
•
Your statutory consumer rights
Nothing in these Terms removes any refund, cancellation, withdrawal, repair, replacement, price-reduction, or other right that you are legally entitled to exercise.
Where applicable consumer law gives you rights that are more favourable than these Terms, those legal rights apply.
20. Price Changes
We may change the price of a paid Fayr plan in the future.
Any change to an existing auto-renewing subscription will be handled through the applicable store and subject to any notice, consent, or other requirements imposed by the store or applicable law.
We will not charge you a new price without following the applicable purchase and subscription process.
21. Acceptable Use
You must not use Fayr:
•
For unlawful purposes
•
To facilitate criminal activity
•
To harass, threaten, abuse, or deceive another person
•
To impersonate another person
•
To create false journey or payment records
•
To gain unauthorised access to another user's account or data
•
To circumvent plan limits or access controls
•
To interfere with the operation or security of Fayr
•
To introduce malware or other harmful software
•
To scrape or systematically extract information from Fayr without permission
•
To reverse engineer Fayr except where applicable law expressly permits it
•
To use automated systems to abuse the service
•
To use Fayr as part of an unlawful commercial passenger transport operation
•
To violate another person's intellectual-property, privacy, or other legal rights
You must not share journey access codes or QR codes with people you do not intend to allow to request access to the relevant journey.
22. Profile Information and User Content
You may be able to provide information such as:
•
A display name
•
A profile photograph
•
Vehicle names
•
Guest names
•
Other information used in connection with Fayr
You retain ownership of content that belongs to you.
You give us a limited, non-exclusive licence to host, process, reproduce, and display that content only to the extent reasonably necessary to operate, secure, and provide Fayr.
You must have the right to provide any content you submit.
You must not upload content that is unlawful, infringing, abusive, deceptive, or otherwise inappropriate for the service.
We may remove content where reasonably necessary to comply with law, enforce these Terms, protect users, or operate Fayr safely.
23. Availability of Fayr
We aim to keep Fayr available and functioning reliably, but no online service can be guaranteed to operate without interruption.
Fayr may occasionally be unavailable because of:
•
Maintenance
•
Updates
•
Technical faults
•
Network failures
•
Third-party service failures
•
Security incidents
•
Events outside our reasonable control
We will provide Fayr with the level of care and skill required by applicable law.
Nothing in these Terms limits your statutory rights if Fayr does not meet standards required by consumer law.
24. Changes to Fayr
We may update Fayr over time, including to:
•
Add or improve functionality
•
Fix bugs
•
Improve security
•
Maintain compatibility with devices and operating systems
•
Respond to changes made by third-party platforms
•
Comply with legal requirements
•
Remove functionality that is no longer viable or appropriate
We will not deliberately make material changes to a paid service in a way that unfairly deprives you of what you purchased.
Where a material change significantly affects a paid subscription, we will provide notice or other remedies where required by applicable law.
25. Suspension and Termination
You can stop using Fayr at any time.
You may also delete your account using the account-deletion functionality provided by Fayr or the process described at fayr.app/delete-account.
We may temporarily restrict or suspend access where reasonably necessary because:
•
You have materially or repeatedly breached these Terms
•
We reasonably suspect fraud, misuse, or unlawful activity
•
Your account presents a security risk
•
We are required to do so by law
•
Restriction is reasonably necessary to protect other users or Fayr
Where appropriate and reasonably practicable, we will explain the reason for the restriction and provide an opportunity to resolve the issue.
We may terminate an account for serious or persistent breaches of these Terms.
Any effect that suspension or termination has on a paid subscription or refund entitlement remains subject to applicable consumer law and the rules of the relevant app store.
26. Discontinuing Fayr
We may decide to discontinue Fayr or a material part of the service.
Where reasonably practicable, we will provide appropriate advance notice.
If discontinuation affects an active paid subscription, we will take reasonable steps to stop future renewals and deal with the affected subscription in accordance with applicable law and the relevant store's processes.
27. Intellectual Property
Fayr, including its:
•
Software
•
Design
•
Branding
•
Logos
•
Illustrations
•
Text
•
User interface
•
Original content
•
Underlying technology
is owned by Anderson Consultants Ltd or used under licence and is protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable right to use Fayr for its intended purpose.
This does not transfer ownership of Fayr or any intellectual property to you.
You may not copy, distribute, sell, license, modify, reverse engineer, or commercially exploit Fayr except where expressly permitted by us or by applicable law.
28. Third-Party Services
Fayr relies on third-party platforms and services, which may include:
•
Apple
•
Google
•
Firebase
•
RevenueCat
•
Device operating-system providers
•
Hosting and infrastructure providers
Your use of some functionality may also be subject to terms imposed by those providers.
We are not responsible for independent third-party services or for matters controlled solely by those providers.
However, this does not exclude any responsibility that applicable law places on us for the Fayr service we provide to you.
29. Other Users
Fayr may display information supplied by other users.
We cannot guarantee that information supplied by another person is accurate, complete, or current.
We are not responsible for the independent acts or omissions of drivers, passengers, guests, or other users.
This includes matters such as:
•
Driving behaviour
•
Vehicle condition
•
Attendance
•
Personal conduct
•
Payment between participants
•
Compliance by another user with insurance or transport laws
This does not affect any responsibility we may have for loss caused by our own breach of these Terms, negligence, or other matter for which the law makes us responsible.
30. Our Responsibility to You
We are responsible for losses that you suffer where they are a foreseeable result of our breach of these Terms or our failure to use the care required by law.
We are not responsible for loss caused solely by:
•
Another Fayr user
•
The operation or condition of a user's vehicle
•
A road traffic incident for which we are not legally responsible
•
A passenger-to-driver payment dispute
•
Information you supplied incorrectly
•
Your failure to comply with these Terms
•
A third-party service where the matter is outside our reasonable control and we are not legally responsible for it
•
Events which could not reasonably have been avoided or controlled by us
Nothing in these Terms excludes or limits our liability for:
•
Death or personal injury caused by our negligence
•
Fraud or fraudulent misrepresentation
•
Breach of rights that cannot legally be excluded
•
Any other liability that applicable law does not allow us to exclude or limit
Nothing in these Terms affects your statutory consumer rights.
31. No Professional Advice
Information and calculations provided by Fayr are intended to support ordinary shared-journey organisation.
Fayr does not provide:
•
Legal advice
•
Tax advice
•
Accounting advice
•
Insurance advice
•
Financial advice
•
Road-safety advice
•
Transport-licensing advice
You should obtain appropriate professional advice where your circumstances require it.
32. Privacy
Our use of personal information is governed by our Privacy Policy.
The Privacy Policy explains, among other things, how Fayr handles:
•
Account information
•
Journey information
•
Location data
•
Vehicle information
•
Cost and settlement records
•
Subscription information
•
Account deletion
33. Changes to These Terms
We may update these Terms from time to time where reasonably necessary, including because of:
•
Changes to Fayr
•
Changes to our business or service providers
•
Security requirements
•
Legal or regulatory changes
•
Changes to the platforms through which Fayr is provided
We will publish the latest version at fayr.app/terms and update the revision date.
Where a change is material, we will provide reasonable notice where appropriate.
If applicable law requires your express agreement to a change, we will ask for it.
Otherwise, continued use of Fayr after updated Terms take effect will mean that the updated Terms apply to your subsequent use.
Changes will not retrospectively remove rights you have already acquired under applicable consumer law.
34. If Part of These Terms Is Invalid
If a court or other competent authority decides that part of these Terms is unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
35. No Waiver
If we do not immediately enforce a provision of these Terms, that does not mean we have permanently given up the right to enforce it.
36. Governing Law and Disputes
These Terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere, you continue to benefit from any mandatory consumer protections provided by the law of the country in which you live where those protections apply regardless of this clause.
Nothing in these Terms prevents you from bringing proceedings in a court that applicable consumer law entitles you to use.
If you have a problem with Fayr, we encourage you to contact us first so that we can try to resolve it.
